Massachusetts DUI law imposes harsh penalties, even for first time offenders, although for ‘firsttimers’ and ‘second timers’ there is an alternative disposition option in return for a plea ofguilty.

The mandatory license suspensions for first time offenders was lowered by the Massachusettslegislature from 90 to 30 days in 2003, but that is if you agree to take the breath test and fail. Ifyou refuse the test, however, the suspension period is now increased from 120 to 180 days -obviously a measure to ‘encourage’ drunk driving suspects to take the test.
How to Choose A Good Massachusetts DUI Attorney
- Interview at least three different attorneys during the mostly free consultations they offer.
- Don just go with whether you like your attorney or not. Often the ‘abrasive ones’ are betterat trying cases.
- Ask how many drunk driving cases the attorney has handled in his career, how many wereresolved on probation by plea bargain, and how many he won at trial or on appeal.
- Determine if the attorney practices mainly criminal defense law, or if he is a civil litigatorwho only occasionally takes criminal cases. (Civil and criminal trial procedures are verydifferent. Just because he tried many cases in civil court, that doesn’t mean he will be successfulin criminal trials as well)
The Problem with ‘Breathalizers’
Many DUI cases are won because the attorney is able to establish reasonable doubt of adefendant’s guilt due to inaccuracies in the breath-alcohol content testing equipment. Someattorneys therefore recommend never to submit for a breath test but to insist on giving a bloodsample at the police station instead.
Blood sample testing procedures are more reliable and less likely to return a ‘false positive.’However, keep in mind the higher mandatory driver license suspension provisions referred toabove. In any case, you should always consult with an experienced Massachusetts DUI attorneybefore you make your final decision on that issue.
