There are two principal categories of SUV accidents: those caused by SUV collisions with other cars, and those caused by SUVs 'rolling over' for a number of reasons.

SUVs are considered 'safer' than other cars principally because in SUV-to-car collisions, the occupants of an SUV usually fare better than occupants of the cars they collide with. SUV drivers and passengers are at considerably higher risks of suffering injuries in rollover accidents, however, because SUVs are higher off the ground which causes instability by creating a higher center of gravity.

Nevertheless, the high rate of deaths reported in SUV rollover accidents is to a large part due to passengers and drivers failing to buckle up. A whopping 75 percent of deaths in SUV rollover cases have been determined to result from failure to wear a seatbelt, rather than inadequate construction of safety precautions by SUV manufacturers.

SUVs tendencies to roll over faster than other passenger cars were somewhat under reported until the Ford Explorer rollover scandal in the late 90s/early 2000s. In individual cases there may still be issues concerning a manufacturer's failure to warn of the dangers of rollover accidents.

Whether you were hurt as a result of an SUV-to-passenger vehicle crash or due to a rollover accident, a competent attorney should be able to properly advise you regarding all issues concerned.

Choosing an SUV Accident Attorney:

Choosing which attorney to hire from any selection can be a daunting task. It is, however, a serious matter, so 'throwing darts' is not the solution, either.

The best practice is to call the offices of at least three attorneys and ask to speak to someone who can answer questions about the firm's or a particular attorney's background and experience.

Here is a list of basic questions every personal injury attorney should be able to answer easily and forthrightly. If he or she cannot, take it as a warning sign and move on to the next one.

  • How many of these types of cases did the attorney handle?

  • How many of these were won at trial?

  • How many of the attorney's personal injury cases generally achieved relatively high-dollar settlement taking the severity of the injury into account?

  • How many of those settlements occurred during >>>mediation<<< compared to informal settlements during the pre-trial stage?

  • How many were lost and the reason why; and

  • How many cases are now on appeal or have been appealed and what was the outcome there?

Only few attorneys will have handled a large number of SUV accident cases. Use your judgment when determining how many cases handled constitute sufficient experience with SUV injuries. However, according to the number of such accidents reported each year (in excess of 10,000), it is reasonable to expect an attorney advertising expertise in such cases to have had at least two or three of them.

What is most important, however, is the level of general trial experience in personal injury-type cases. It would probably be a good idea to choose a lawyer with at least five to ten full-blown jury trials 'under his belt.'

An attorney's attitude and general treatment of you personally can be a deciding factor if the other criteria are mainly satisfied by two attorneys and you have a difficult time of making up your mind.
