Any attorney who is board certified in civil trial law will be competent you represent you if you or a loved one have been injured as a result of an ATV or all terrain vehicle accident. However, personal injury trial law is a more focused sub-specialty when it comes to ATV accident litigation.

When you go your client interview with the lawyer(s) of your choice, it would therefore be a good idea to ask him or her how many ATV cases he has already handled, and what the outcomes were. For example:

  • How many cases were won at trial?

  • How many cases achieved relatively high-dollar settlement taking the severity of the injury into account?

  • How many of those settlement occurred during >>>mediation<<< compared to informal settlements during the pre-trial stage?

  • How many were lost and the reason why; and

  • How many cases are now on appeal or have been appealed and what was the outcome there?

Don't be surprised if a lawyer does not have a whole lot of cases in each category. One or two total wins should be enough to show you he knows what he is doing.

The best advice we can give you for picking a lawyer is this:

Make your own list of questions according to what you want to know. Schedule a first meeting with more than just one lawyer. Once your choice comes down to two layers and you feel they answered your questions about equally well, trust your gut feeling. Go with the one you 'feel' most comfortable that he will really fight for you.

First use your brain to make the most rational choices, and then use your gut if your brain is still undecided. Don't do it the other way around.
