THE RULE OF BLAWG

For the Rule of Law to mean anything, law makers, enforcers, and interpreters must be subject to it, just like private citizens are. It is ordinary Americans and their lawyers who have the essential duty to enforce it on their elected representatives and their appointees.

I will publish any well reasoned contributions or deliberations on these issues, whether they are from attorneys or laymen. Contributors can either found their presentations or arguments on existing legal authority, or attempt to show how existing legal authority on the subject is deficient and should be changed. They can even present a straight opinion piece here, but it must be well reasoned and well thought out.

This is not an ivory tower discussion for attorneys, only. It is a dialog between attorneys and laymen who have something important to say on legal issues as they concern the Constitution and the rule of law in this country.

Nov 4, 2007, A Legal-Philosophical Question:

Actually, I have two questions:

1. If a US law - any law, whether of a statutory, judicial, or executive-decision nature - does not protect an individual's life, liberty, and property, from where does it derive its legitimacy?

2. If a law does protect these things, from where does it derive its legitimacy?
